Judge Webb Shuts Down Work on New Stanly County Courthouse, March 14, 1922

Judge Webb Rules Against Board of Commissioners in Court House Case. . . Restraining Order Is Made Permanent, and No Further Steps Can be Taken Until After Election or Final Hearing

Stanly County’s vision of a new $250000 court house went to smash on last Saturday when Judge James L. Webb of Stanly handed down his judgment in the matter of Dr. T.A. Hathcock and others, plaintiffs against the Board of County Commissioners of Stanly County and other defendants. The judgment of Judge Webb ordered that the temporary restraining order heretofore granted in this case by Judge Ray restraining the Board of Commissioners from taking further steps towards the building of the new court house, be continued in full force and effect until the election provided for by the act of the legislature at its last special session, or until the final hearing in the case at term time. The order also restrains the defendants, their agents and attorneys from taking any further step in their attempt to change the present site of the court house and jail and to purchase or pay for the property proposed for the new site. This, of course, settles the matter, unless the majority of the qualified voters of the county at the election in November shall say by their ballots that they are in favor of the building of a new court house, as the case cannot be heard at term time before that date, and as the Supreme Court could not reach the case for hearing upon appeal sooner than that, even though the Board of Commissioners should appeal from Judge Webb’s decision. We have heretofore printed the full text of the complaint of order of Judge Ray granting the temporary restraining order. We have also printed the full text of the answer filed by the board of county commissioners, and believing that our readers will be interested, and knowing this to be a matter that touches every citizen and tax payer in the county, we quote in full Judge Webb’s order, which is as follows:
