Coopers Are to Each Serve in Federal Prison. . . Former Lieutenant Governor of State Is Found to be Guilty

Wilmington, N.C., Feb. 14—A jury in the United States District court today found former Lieutenant Governo W.B. Cooper and Thomas E. Cooper guilty on four courts of misappropriation of the funds of the Commercial National Bank and of making false entries on the books of the institution.

Federal Judge J.C. Rose sentenced T.E. Cooper to three years in the Atlanta Penitentiary on each account and W.B. Cooper to 18 months on each count. The sentences will run concurrently.

In a charge of an hour’s duration, Federal Judge J.C. Rose presented the law governing the charges against Thomas E. Cooper and W.B. Cooker, who have faced trial during the past seven days on various counts involving alleged violations of the National banking laws. The charge was regarded as a fair exposition of the principles surrounding the cases, although as was to be expected, quite a number of exceptions were filed by attorneys for the two defendants. These exceptions were permitted by the court, and will represent a part of the record in the event the cases eventually should go to the Circuit Court of Appeals under appeal from possible verdicts in the district court.

In the commencement of the charge, Judge Rose indicated that while originally there were 134 counts in the bill of indictment, nine of these had been abandoned by the Government. The four remaining charges, the court stated, involved general allegations of misappropriation of funds, and of making false entries with intent to deceive, either the comptroller of the currency or National bank inspectors.
