McNinch Wins Damage Suit. . . American Trust Company Called on to Pay $20,344 and Trial Costs

The jury in the S.S. McNinch case returned a verdict of $20,344 in favor of the plaintiff. Shortly after noon the members reported they had agreed and at once they filed into the court room where Judge W.F. Harding had gone to see if there was any likelihood of agre3ement. The defendant pays the costs in the case.

Attorneys for the American Trust Company, the defendant, at once made a motion for a new trial on the grunds that the verdict was against the preponderance of evidence. The argument on the motion will be made before Judge Harding next Saturday.

The jury answered all six issues in favor of the plaintiff, including the one as to whether the plaintiff had a parole agreement with the defendant company not to sell his property, on which it had a $34,000 mortgage, without his consent and approval.
