No probable cause in the case charging manslaughter as the result of the automobile accident and death of Harry E. Cain Friday afternoon on the Beatty’s Ford road was found against P.C. Gilland, chief mechanic of the Alexander Garsed Company in the preliminary hearing before Squire J.W. Cobb Saturday morning.
It was testified that Mr. Gilleland gave the signal to pass the car driven by O.P. Lippard in which Mr. Cain was riding, and when he tried to pass, the car ahead moved to the left instead of to the right. Then the front wheel of the Lippard car struck the rear wheel of the Gilliland machine, causing the Lippard car to topple over.
Witnesses who took the stand were Mrs. Oscar Bridges, Mrs. W.W. Gilbert and Frank Hucks, residents of the road near the scene of the accident, who saw the mishap. Jim Paxton, rural policeman, who went out to the accident, told the court of his conversation with Mr. Gilleland and Mr. Lippard. Earl Gilleland, son of the defendant, also testified.
