Commissioners Correct in Removing Sheriff Taylor, Says Judge Midyette, June 10, 1925

Arden Taylor Must Vacate His Office. . . Judge Midyette Holds with County Commissioners of Lenoir in Ousting the Sheriff

Kinston, June 8—In Superior court here today Judge Garland Midyette sustained the Lenoir county commissioners’ contention that they were within their rights in ousting Arden Taylor from the sheriff’s office last December and appointing a successor to Taylor. The decision means that Taylor, claiming to be the lawful sheriff of the county, must vacate public quarters pending the hearing of an appeal from the commissioners’ action. His jailer, Thomas Conway, will e required to vacate the county prison.

Judge Midyette held that there was no matter of accounting before him. The commissioners claim Taylor owes the county many thousand dollars. Taylor asserts the county is indebted to him. Affidavits were introduced by Taylor’s counsel in today’s mandamus hearing in an effort to prove a conspiracy. The allegations were denied by the latter.
