There were no developments of importance yesterday in the contest over the custody of Pembroke Rees, the 3-year-old child of Arthur D. Rees of Philadelphia, and Mrs. Mary Graves Rees of Chapel Hill, who are living apart. At present by order of Judge Bond, the child is in custody of his grandmother, Mrs. Julia C. Graves. The order, in the form of a writ of habeas corpus, was returnable before Judge Devin in Roxboro Friday, but the case did not come to argument.
Maj. L.P. McLendon, Mrs. Rees’s attorney, was ill yesterday, but is expected to be well by Monday. Mrs. Rees is willing that the father see the child as often as possible in Chapel Hill and that, when the boy grows older, he spend part of the time with the father but she should have the care of him. If no settlement should be reached, it is probable that Judge Devin will hear the argument in Graham early next week. R.O. Everett is Mr. Rees’s attorney.
The case attracted state wide attention several weeks ago when the father while visiting in Chapel Hill for the purpose of seeing his son, kidnapped him and carried him to Philadelphia. Mrs. Rees, with her brother, Louis Graves, followed them to the Quaker city and retained possession of the boy, bringing him back to Chapel Hill.
