Papers were filed Saturday with the clerk of the Superior court, W.H. Young, in suit, Clarence E. Boesch, trustee, Elliott-Sholes company, vs. Jack Long. The complaint alleges that the Elliott-Sholes company sold the defendant a concrete mixer for $350, and on November 16, 1923, the plaintiff gave a check to cover the indebtedness. When the check was presented at the Home Savings Bank, it is alleged, there was no money to meet it.
