Trial of Kohler Holtsclaw, Accused of Murder, July 14, 1920

Not Begun Yesterday

On motion of Mr. A.A. Whitener, attorney for Kohler Holtsclaw, Judge McElroy in Catawba superior court discharged the special venire of 100 men and ordered the sheriff to summon 100 men to report at Newton at9:30 this morning. The veniremen were dismissed because they were not summoned by the sheriff and his deputies, and immediately after their discharge, Sheriff Isenhower, Deputy Sheriff Kennedy and other officers proceeded to guard the exits from the court house and tagged all who came out.

It was not believed the jury would be selected before early this afternoon and the case, instead of being concluded today, as was at first thought likely, probably will run through noon tomorrow.

Quite a number of witnesses, most of them persons who saw Holtsclaw shoot John W. Gabriel at Terrell last December, will testify today. One of the defendant’s witnesses, the young woman over whom the killing is alleged to have occurred, is said to be in Tennessee, and is out of the jurisdiction of the court.
