Evans Forbes, 43-year-old machinist residing at 18 Glade street, was brought into court late Thursday in the custody of Deputy Sheriff Pritchard as a result of two true bills found against Forbes by the Pasquotank Grand Jury, which has been in session this week.
The bills of indictment against Evans Forbes read as follows:
“The jurors for the State upon their oaths do present that Evans Forbes, late of the County of Pasquotank, on or about the 2nd day of March in the year of our Lord 1924, with force and arms at and in the County aforesaid unlawfully, willfully, and feloniously did conspire, plan and design with “John Doe” and divers persons to the Jurors unknown to break or enter the jail of Pasquotank County, N.C., a place of confinement of prisoners charged with crime, particularly Elwell Overton, for the purpose of killing or otherwise injuring said Elwell Overton and other prisoners confined therein.”
Two bills of indictment in the foregoing language were presented by the grand jury and they are precisely alike except that one bill is entitled an indictment on a charge of conspiracy to break or enter a jail to injure prisoners, while the other bill charges a conspiracy to attempt to commit the same offense.
Bond in the sum of $1,000 was required of the defendant and it was promptly given.
