On Wednesday of this week Will Hurt and nephew decided to take charge of Smoky Mountain, near Newland, N.Y, in Allen clan fashion and drive all the inhabitants away by firing on all those who came and went.
The sheriff and his deputy, Bowman, was notified and proceeded to take them. Mr. Bowman being the first to come in contact with them, he being in such close quarters with them, was forced to surrender one of his weapons, a shot gun, and was covered with both men’s guns. Mr. Vance, having gone a different direction, happened on the scene, but in rear of the men, and after due precaution slipped near enough to reach behind Will Hurt and snatch his revolver from, while Bowmen proceeded to handcuff him and Hurt, seeing an opportunity snatched Bowman’s revolver from, firing on him two or three times, without effect, then turning on Sheriff Vance, fired on Hurt, shooting him square through, which caused instant death. Hurt’s nephew was arrested without trouble.
